Constitution of Islamic Republic of Pakistan 1973 under Article 15 grants following right to every citizen
Freedom of Movement:
15. Every citizen shall have the right to remain in, and, subject to any reasonable restriction imposed by law in the public interest, enter and move freely throughout Pakistan and to reside and settle in any part thereof.
Legal interpretation of the above article by the high courts of Pakistan is as follows:
- In the case # 2022 PLD 119 LHC, the Honorable court have held that Article 15 includes right to travel abroad.
- In the case # PLD 1987 SC 504, the Honorable court have held that Right to international travel as part of liberty.
Can the authorities prevent you from leaving Pakistan?
Have you recently been off-loaded or prevented from leaving Pakistan or been arrested or detained by the airport authorities? If you were not presented with a written reason or a judicial warrant, the action may have been unlawful and you may be entitled to hold those responsible accountable.
According to the Constitution of the Islamic Republic of Pakistan 1973 and existing legal principles, there is no legal way for authorities to stop someone from leaving the country unless the following requirements are fulfilled:
- Valid passport.
- Valid work or visit visa for the destination country.
- Return ticket (in case of a visit visa).
- Hotel bookings for the visit visa.
- Sufficient funds to support the stay abroad for the declared period.
Pakistani citizens have experienced mass off-loading from airports across Pakistan, including illegal arrests and detentions of overseas Pakistanis. The government may only arrest or detain someone with a judicial warrant issued by a competent court; otherwise, the arrest or detention is illegal or unwarranted.

Well the answer to the above question is somewhat complicated but we will try to surmise it as much as possible. According to the Constitution of Islamic Republic of Pakistan 1973, exiting legal frame work, set principles there is no legal way for authorities to stop someone from leaving the country, unless they don’t have the following requirement fulfilled:
- Valid Passport,
- Work or Visit Visa of the destination country,
- Return ticket (incase of visit visa),
- Hotel Bookings (for visit Visa), and
- Sufficient funds to support one’s stay abroad for the period of stay in the visiting country (the minimum amount has to be decided by the country of stay).
Now the second part of the above question about arrests or detention, the answer is yes but to arrest someone the authorities have to have a Judicial warrant of arrest for the person in order to arrest them, otherwise the arrest or detention will be illegal or unwarranted.
